ICCA Yearbook

 

Since 1976, the Yearbook Commercial Arbitration has been a major source of information concerning international arbitration jurisprudence. Published under the guidance of General Editor Professor Stephan Schill, and with the assistance of the Permanent Court of Arbitration, the Yearbook provides an annual update on key court decisions on arbitration from around the world that apply the major multilateral arbitration conventions or address issues of general interest to the practice of international commercial arbitration, summarized and indexed. The Yearbook also includes announcements of new arbitration rules and recent developments in the law and practice of several countries, as well as a comprehensive bibliography prepared in cooperation with the Peace Palace Library.

"Iran has been a member of the New York Convention for a near quarter of a century. In light of the harmonization of the structure of arbitration, the Law for International and Commercial Arbitration (“LICA”) was adopted in 1997. The Law is largely inspired by the UNCITRAL Model Law while domestic arbitration is governed by the Civil Procedure Code. In order to foster a pro-arbitration environment in Iran, it is necessary for the ambiguities of the objective arbitrability restriction under Article 139 of the Constitutional Law to be taken into consideration."

"The Federal Court, the apex court of Malaysia, in Arch Reinsurance Ltd v. Akay Holdings Sdn Bhd [2018] MLJU 2117, considered the thorny question of arbitrability. The Federal Court decided that disputes in relation to charges under the National Land Code 1965 were not arbitrable, as the Code allowed a party to enforce such charges by court proceedings, which rights in the Code are exhaustive and exclusive. Therefore, any attempt at contracting out of these rights, by way of an arbitration agreement, would be contrary to public policy and thus void. This judgment shows that, although Malaysia is an arbitration friendly jurisdiction, there are limits to the types of disputes that are arbitrable."
