Report: ICCA-ASIL Task Force on Damages in International Arbitration Seminar at IBA Annual Conference in Seoul 

On Monday, 23 September 2019, on the occasion of the IBA Annual Conference in Seoul, the ICCA-ASIL Task Force on Damages held a one-hour seminar to update attendees on its work to develop an app to assist practitioners and arbitrators with issues related to damages.The Task Force was represented by co-chair Gabrielle Nater-Bass and Task Force members Sarah Grimmer and M. Alexis Maniatis. The seminar was supported by KCAB International and hosted by the Seoul International Dispute Resolution Center.

After opening remarks by Prof. Hi-Taek Shin, Chairman of KCAB International and member of the ICCA Governing Board, Gabrielle Nater-Bass demonstrated how the app interactively and comprehensively maps out the various procedural, legal and financial issues that arise in relation to damages and locates sources for further research. She announced its expected launch in May 2020 at the ICCA Congress 2020 in Edinburgh. The panelists then demonstrated how one could use the app by focusing on select issues related to damages, including matters of procedure (bifurcation and the use of experts), international law (the appropriate valuation date), common law (causation, limiting principles of compensation), and financial issues (post- and pre-award interest).

The seminar concluded with the confirmation that the app will be made available as a free resource with the goal of improving the quality, consistency and rigor with which damages issues are addressed in international arbitration.
